민중기 특검은 국가권력으로부터 허가받은 '살인자'!

민중기특검에게 조사 받던 공무원이 특검의 강압적 수사를 견디다 못해 극단적 선택을 했다.

그가 작성한 메모 내용을 보면 민주당에서 검찰의 수사권을 없애야 한다고 주장하는 이유가 다 나와 있다. 강압, 강요 회유, 협박 등. 그리고 피해자의 수모와 치욕.... 검찰이 권력 앞에 변한 것은 여전히 하나도 없다.

더 어이가 없는 것은 특검의 뻔뻔한 태도다. 특검수사로 인해 자살한 공무원의 유족에 찾아가 무릎꿇고 머리를 조아려도 시원치 않은데 특검팀은 "(조사가) 강압적인 분위기도 아니었고 회유할 필요도 없었다"는 입장이다.

특검은 전날 오전 10시부터 조사하여 다음날 0시 52분에 귀가시켰다고 밝혔는데 시골의 순진한 공무원을 15시간이나 잡아놓고 수사한 것 자체가 강압이고 협박이다. 그리고 강압 여부는 당하는 쪽에서 느끼고 판단하는 것이지 가해자가 판단할 사항은 아니다.

특검 주장대로 수사가 편안했다면 공무원은 도대체 왜 치욕과 수모를 못 참아 자살했을까? 이들은 여지껏 이런 식으로 강압수사를 은폐·변명해 왔다. 자살한 공무원이 남긴 메모가 조작이 아니라면 민중기특검은 국가권력으로부터 허가받은 살인자와 다름이 없다.

평생 검찰 수사는커녕 경찰의 수사도 받아보지 못한 순진한 시골 공무원이 동네파출소에만 불려가도 겁을 먹는데, 특검의 소환통보를 받았을 때부터 불안감에 시달렸을 것이다. 잔뜩 겁먹은 그가 검찰, 그것도 살아있는 권력을 등에 업은 무소불위 특검의 수사실에 불려가 15시간이나 협박 받으며 거짓진술을 강요 받았으니 그의 정신적 스트레스는 극에 달했을 것이다.

본인이 아니라고 하는데도 거짓진술서를 만들어 서명하라고 강요까지 했다니 서명에 대한 죄책감이 얼마나 심했으면 그 사실을 메모에 남겼을까? 육체적 고문만 없었지 독재 정권 시대의 중앙정보부 수사 방식과 하나도 다를 바 없다.

육체적 고문만이 고문이 아니다. 압박, 회유, 거짓진술 강요, 그리고 서명은 순진한 시골 공무원에게는 정신적 학대와 고문이나 다름이 없다. 수사 과정에서 그가 느꼈을 수치심과 치욕에 공감이 간다.

분명 수사과정에서 생긴 극심한 스트레스가 자살로 이끌었을 텐데도 민중기특검은 진솔한 사과보다는 책임을 회피하려 변명만 일삼는다.

민중기특검은 이제 도덕적 정당성을 상실했다. 민중기 특검이 그동안 수사하고 발표한 모든 피의사실들이 특검의 강요, 회유, 협박 그리고 조작이 개입됐다는 의심을 피할 수 없다. 하나를 보면 열을 알 수 있다.

"권력은 양날의 칼과 같다"는 말이 있다. 그리고 "토사구팽"이란 고사성어도 있다. 지금은 그들이 미친 망나니처럼 휘두르는 권력의 그 칼날이 언젠가는 자신에게 향할 수 있음을 명심해야 한다.

민중기특검이 이렇게 도덕적 명분을 상실하면서까지 무리한 수사를 계속하는 것은 무슨 이유에서일까? 죄인을 단죄하겠다는 사법적 정의감? 누구 말대로 사초를 쓰는 자세로? 아닌 것 같다.

특검 기간 중 현 정권의 마음에 쏙 드는 결과를 만들어 현 정권에서 한 자리 얻어보겠다는 시커먼 욕심으로밖에 안 보인다. 그에게는 권력에게 보여줄 결과가 중요하지 누가 자살하건 말건 불법적 수사 과정은 중요하지 않다.

그는 특검이 끝난 후 얻을 자리에 취해 진실을 밝힌다던가 정당하고 합법적인 수사를 할 의지는 처음부터 존재하지 않은 것 같다. 진실보다는 진술조작 같은 불법적 방법을 동원해서라도  권력에 아부할 결과만 중요했다.

이번 수사과정에서 드러난 조작된 진술서가 그 대표적 증거다. 이런 불법적이고 수치스런 수사를 용인하는 그에게 과연 정의라는 것이 조금이라도 남아 있는지 궁금하다.

이런 사람이  서울중앙지법원장까지 거친 판사 출신이라는것도 정말 놀랍다. 민중기특검이 역사에 남을 자신의 명예로운 이름보다 순간의 영광에 집착하면 결국 패가망신하고 역사에 오명만 남는다.

Facing the overwhelming authority of a special counsel backed by a sitting administration, being interrogated for 15 hours under pressure, and being forced to sign a false statement must have pushed him to the psychological brink.

Even without physical torture, psychological coercion— intimidation, manipulation, forced confessions, pressured signatures — can be just as brutal. One can easily imagine the humiliation and disgrace he must have felt during the interrogation. And yet, rather than offering an honest apology, the special counsel is busy making excuses and denying responsibility.

Min Joong-ki has lost all moral legitimacy. Every case he has pursued now faces the shadow of suspicion — coercion, manipulation, intimidation, and fabrication.One case reveals the pattern.

Power is a double-edged sword, as the saying goes. Those who wield it recklessly must remember: the blade can one day turn back on them.

Why is Min pushing such aggressive investigations, even at the cost of moral authority? A sense of justice? A commitment to truth? It doesn’t seem so. This looks like a desperate bid to produce results that please those in power — a way to secure a future position once his special counsel term ends.

He seems more interested in outcomes that will impress political leaders than in lawful, fair investigations. The manipulated interrogation record in this case is damning evidence. It raises serious doubts about whether any sense of justice remains in a man who once served as the head of the Seoul Central District Court.

If Min Joong-ki continues to chase fleeting glory over principle, he will not be remembered as a hero — only as a disgraced figure in history.
